Georgia May Allow Medical Cannabis Delivery Soon

Georgia’s medical cannabis program continues to grow, but most folks in the State of Georgia don’t live anywhere near a convenient medical cannabis dispensary. Thank goodness the Georgia Access to Medical Cannabis Commission (“GMCC”) seems to understand this is a problem for patients.


According to a public notice, the GMCC is considering a new rule that could dramatically reshape access for thousands of patients: allowing licensed dispensaries to deliver medical cannabis directly to registered cardholders.


So what happens if the GMCC adopts the proposed new rule? If adopted, the new rule would let Georgia’s licensed dispensaries deliver medical cannabis products to: registered patients, registered caregivers, or approved healthcare institutions.


Wait?! Are they trying to get rid of dispensaries? No. Don’t worry. The GMCC is not trying to get rid of the brick and mortar dispensaries. The new rule would simply give patients (like us) another way to receive their medicine, which sounds especially nice for those who live far from a dispensary, participating pharmacy, or have mobility challenges.


Will things change overnight if the proposed rule is adopted? Not exactly. Per the proposed rule, before a dispensary can deliver any medical cannabis products, they’ll be required to submit a detailed delivery plan to the GMCC’s Executive Director. This plan would detail how the dispensary will ship the products, track the deliveries, handle product recalls, and verify patient identity and registry status.


What would the patient delivery experience actually look like? Well… time will certainly tell. However, based on what we’ve seen so far, we expect delivery will likely be restricted to only the address on your ID. In addition, only the registered patient or registered caregiver would be able to sign for the medical package. Finally, the actual delivery options are expected to be limited to USPS Certified Mail, recognized private carriers (like FedEx, UPS, DHL, etc.), and/or the GMCC itself (or a private carrier hired by the GMCC).


Let’s be honest. Is this the robust delivery option that patients want and need? No. Not at all. But it’s a strong first step in the right direction.


How do patients tell the GMCC what we want and need? The GMCC is actively asking for public input. Patients can share their thoughts in two ways:

NOTE: to speak at the hearing, you must email rules@gmcc.ga.gov by September 9 (and include the following in your email: your name, contact information, and the rule number you want to speak about (Rule 351‑6‑.11 “Delivery”). It’s that easy y’all!
